Author: NEHA GANPAT NARAKE Webware | Jan 11, 2020

Additionally, the Federal Skilled Worker Class requires applicants to have their foreign educational credentials assessed for Canadian equivalency by a designated Canadian accreditation body.

  • Are there special immigration procedures for different provinces in Canada?

Author: NEHA GANPAT NARAKE Webware | Jan 11, 2020

Certain provinces have been given the authority by Immigration, Refugees and Citizenship Canada (IRCC) to select or nominate candidates for immigration destined to their respective province under the Provincial Nominee Program. Quebec has exclusive authority to select candidates who intend to reside in that province. These applicants are subject to Quebec's selection criteria, in addition to Federal medical and security clearance requirements. They must also pay an additional fee for processing by Quebec immigration authorities. Applicants who qualify under the Federal selection requirements may not necessarily satisfy Quebec's selection requirements, and vice versa.

  • Can a candidate apply directly to a province under a Provincial Nominee Program (PNP)?

Author: NEHA GANPAT NARAKE Webware | Jan 10, 2020

Yes, a portion of the PNPs, known as the "enhanced" portion, will be inside Express Entry, with the remainder operating external to Express Entry. If a candidate is eligible for a particular PNP and that PNP is receiving applications for assessment at the time, he or she may make an application to that particular province under the PNP without having to create an Express Entry profile. The Canada Visa immigration assessment form assesses your eligibility for immigration across more than 60 immigration programs, including the various PNPs.

  • Can a candidate still qualify for the Canadian Experience Class if he or she has acquired a one-year degree or certificate from an approved Canadian post-secondary educational institution?

Author: NEHA GANPAT NARAKE Webware | Jan 10, 2020

When considering education, all candidates must have acquired at least two years of academic study in Canada and must have graduated from an approved Canadian post-secondary educational institution to qualify for the Canadian Experience Class. There is, however an exception to this rule. A candidate would still be eligible for the Canadian Experience Class in the event that he or she has completed a one-year Master’s degree after completing another program that is one year in length and from an approved Canadian post-secondary educational institution. The programs must be completed within two years.

  • Can a candidate submit an application to the QSWP if he or she intends to live elsewhere in Canada?

Author: NEHA GANPAT NARAKE Webware | Jan 10, 2020

The QSWP program is intended for prospective immigrants who wish to settle and build a life in Quebec. An application can be refused if the MIDI or the federal immigration authorities believe that the applicant does not intend to settle in Quebec. Once a successful applicant receives a permanent resident visa, he or she (and his or her family, if applicable) must land in Quebec upon arrival in Canada. However, it is important to note that immigrants who obtain permanent residence through the QSWP have the same rights as Canadian citizens and permanent residents in other provinces to move around…

  • Can a file be transferred from one Canadian Immigration Visa Office to another?

Author: NEHA GANPAT NARAKE Webware | Jan 10, 2020

A request to transfer an application to another Canadian Immigration Visa Office may be made to the Canadian Immigration Visa Office processing the file. The Canadian Immigration Visa Office will decide, based upon “program integrity”, whether or not to transfer the application. In certain circumstances, the Canadian Immigration Visa Office processing a file may decide on its own to transfer the file to a different, more appropriate Canadian Immigration Visa Office, even without a request.

  • Can a work permit be extended if it expires before the federal processing stage for permanent residence is complete?

Author: NEHA GANPAT NARAKE Webware | Jan 10, 2020

To extend a work permit, the applicant would need to obtain a job offer from an employer. Such a job offer would be exempt from a Labour-Market Impact Assessment (LMIA) as the applicant has a CSQ. The applicant may then take the job offer and his or her CSQ to a Quebec Port of Entry to obtain a closed work permit for that employer. Applicants can only obtain a new or renewed work permit if they are currently residing in Quebec with a valid work permit. For a graduate applicant living in Quebec on a post-graduate work permit that will…
